Terms and Conditions

These are the terms and conditions of sale (hereinafter: “Terms of Sale”) of Jnz Dynamics bv, trading as Squibblle, with its registered office at Gentsesteenweg 12A, 9239 Wetteren, and registered with the enterprise number BE0805.697.538.


Article 1 – Scope of application


These Terms of Sale apply to any offer made by us as seller to you as a Consumer (any natural person who purchases our products or services exclusively for non-professional purposes) or Professional Customer (any person who purchases our products or services exclusively for professional purposes) through our website www.squibblle.be.


The terms listed below apply to both Consumers and Professional Customers, unless a specific provision applies exclusively to either the Consumer or the Professional Customer. In some provisions, there’re referred as “the Customer”.


To place an order, you must be at least 18 years old. If you are not 18, we ask that you have your parents or legal guardian place the order. If we find that an order has been placed by a minor, we may refuse that order.


Placing an order on the website constitutes express acceptance of these General Terms and Conditions of Sale, which are always available on the website.


If you order online, we will also provide you with a copy of these General Terms and Conditions of Sale in a format that you can save or print, either together with the order confirmation or, at the latest, upon delivery. We recommend that you always do this.


In addition to these General Terms and Conditions of Sale, additional special terms and conditions may also apply such as, for example, our Terms of Use. Should our General Terms and Conditions of Sale conflict with these special conditions, the Consumer may invoke the most advantageous text in your favor.


Article 2 – Offer and order


If an offer only has a limited validity or is subject to certain conditions, we expressly state this in our offer.


On each product page you will find as complete and accurate a description as possible of what we are selling you. This description is sufficiently detailed to allow you to make a proper assessment. If we use (product) images, they are a true representation of the products or services offered, unless we have made an obvious mistake. In that case we are not bound by our offer.


Your order is complete and the agreement between us is final as soon as we confirm your order by email and as soon as we receive your payment. If your bank card issuer refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. We will not accept or process orders without valid payment in the name of the registered cardholder.


To purchase a product, add the product to your shopping cart. To checkout enter your contact information, billing information and delivery address. At the checkout page you get a summary of your order, accept our General Terms and Conditions of Sale and confirm your payment by pressing the order button captioned “Place Order” or similar. Once you have completed these steps, your purchase is final.


Article 3 – Consumer right of withdrawal


If you purchase goods or services as a Consumer (a person who buys products or services for non-professional purposes), you have the right to decide that you do not want to keep the goods or services. This right can be invoked up until 14 days from delivery (for products) or from the conclusion of the agreement (for services). You can then revoke your order without paying a penalty and without giving any reason.


Within 14 days after we have received your order back or you have indicated that you wish to withdraw from the agreement, we will refund you the full purchase price thereof using the same means of payment with which you paid.


Regarding the withdrawal of the purchase of products, the Consumer must additionally consider the following conditions:


– You have to bear the direct cost of returning the products.


– We may withhold reimbursement until we have received the products back or until you have demonstrated that you have returned them, whichever comes first.


– During the first 14 days after delivery, we expect you to handle your ordered products and their packaging with care. If you still wish to return the products as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep the product. Returned products may be fitted but not used. When you return the products, it must be done, if possible, together with the original packaging, with all delivered accessories and in the original condition and packaging and considering our instructions below.


The Consumer acknowledges and accepts that he has no right of withdrawal regarding the provision of services if the following conditions are met:


– The Consumer has clearly agreed in advance to the performance of the contract during the withdrawal period;


– The Consumer has expressly acknowledged losing his right of withdrawal when giving his consent.


The Consumer acknowledges and accepts that he has no right of withdrawal regarding the delivery of digital content (not on a tangible medium) if the following conditions are met:


– The Consumer has clearly consented in advance to the performance of the agreement during the withdrawal period;


– The Consumer has expressly acknowledged losing his right of withdrawal when giving his consent.


To exercise your right of withdrawal, both in the case of delivery of services and delivery of goods, you can use the following withdrawal form:

Article 4 – Price


During the period stated in our offer, our prices do not change, except for price changes due to changes in VAT rates.


Our prices include all taxes, VAT, duties and services.


The shipping costs to be paid by the Customer are clearly displayed in the ordering process, except for custom duties.


Article 5 – Custom duties


If you’re delivery address is outside the European Union, you may have to pay customs fees.


You are responsible for paying additional charges such as duties, taxes and customs fee.


Most customs fees are due once the package arrives in the destination country. The charges are based on:


– The price and type of item;


– The weight and dimensions of the package;


– The country of origin of the package;


– The destination country’s taxes, duties and fees.


At checkout, you will be notified that additional fees and charges may apply. However, this notice does not mean that additional charges are guaranteed for your order. You can contact your local customs department to find out if there are additional charges for your order.


Article 6 – Payment


We accept payment via VISA, Mastercard, American Express, Discover, Diners Club, Stripe and JCB.


To ensure safe online payment and the security of your personal data, the transaction data is encrypted with SSL technology over the Internet. You do not need any special software to pay with SSL. You can recognize a secure SSL connection by the “lock” in the lower status bar of your browser.


Article 6 – Compliance and warranty for Consumers


Only the legal warranty applies to the goods ordered by you. We apply the legal minimum warranty period of two years when delivering products that do not conform to the order you have placed.


This means that if the product is faulty or defective, we will repair or replace it free of charge up to 2 years after delivery.


To the extent possible and reasonable, you have the choice between repair or replacement. Only in case the repair or replacement is excessive or impossible or cannot be performed within a reasonable time, you have the right to request a price reduction or the dissolution of the sales agreement.


Please note that this warranty expires when the products are incorporated into other products.


Article 7 – Delivery and execution


We deliver the products ordered by you in or to the delivery address you indicated at the time of your order.


Shipments within the European Union are processed within 3 business days of placing the order.


Shipments outside the European Union are processed within 3 business days of placing the order.


If delivered products were damaged during transport, do not match the items listed on the delivery note or do not match the items you ordered, you must report this as soon as possible and certainly within 24 hours of receiving the product.


Article 8 – Force majeure


Force majeure is any circumstance beyond our will and control that prevents the fulfillment of all or part of our obligations. By this we mean, among other things, strikes, fires, business interruptions, power failures, failures in a (telecommunications) network or connection or communication systems used and/or the unavailability of our website at any time, non-delivery or non-timely delivery of suppliers or other third parties engaged, ….


In case of force majeure, we are not obliged to fulfill our obligations. In that case, we can either suspend our obligations for the duration of the force majeure or dissolve the agreement definitively.


Article 9 – Intellectual Property


Our website, logos, texts, photos, names and in general all our communications are protected by intellectual property rights that are either ours, our suppliers or other right holders.


You are prohibited from using and/or modifying the intellectual property rights described in this article. For example, you may not copy or reproduce drawings, photos names, texts, logos color combination, … without our prior and express written consent.


Article 10 – Liability


We shall not be liable for any direct or indirect damages for which we have not expressly determined our liability in these General Conditions of Sale.


We shall never be liable for any indirect and/or any consequential damages. In any case, our total liability shall always be limited to direct damages and shall never exceed the price paid by the Customer to us for the products or services that directly gave rise to the claim, with a maximum of 10.000EUR.


Article 11 – Privacy and protection of personal data


Jnz Dynamics bv, with the trade name Squibblle, with registered office at Gentsesteenweg 12A, 9239 Wetteren (Belgium), and registered in the K.B.O. under number BE0805.697.538. is the Controller who will process the Customer’s personal data in accordance with the Privacy Policy available through the following link: https://squibblle.com/privacy-policy/.


Article 12 – Other provisions


These General Terms of Sale, together with the offer or order form, constitute the entire agreement between the Customer and us, with respect to the subject matter contained therein.


If one or more provisions of these General Terms of Sale should at any time be wholly or partially illegal, void or for any other reason unenforceable, this clause shall be deemed severable from the General Terms of Sale and shall not affect the validity and enforceability of the remaining provisions.


Article 13 – Consumers complaints and disputes


We always hope that all our customers are 100% satisfied. However, should you have any complaints about our products or services, please contact us at support@squibblle.com. We will do everything we can to deal with your complaint within 2 working days.


In the event of out-of-court settlement of the dispute, the Consumer Mediation Service is authorized to receive any request for out-of-court settlement of consumer disputes. The latter, in turn, will either handle the request itself or forward it to a qualified entity.


In the case of disputes of a cross-border nature, you can also use the European Union’s Online Dispute Resolution platform via this link: http://ec.europa.eu/odr.


Article 14 – Applicable law and Jurisdiction


All agreements we enter into with our Customers, regardless of their place of residence, are governed exclusively by Belgian law and, in the event of a dispute, the court in the judicial district where our registered office is located has exclusive jurisdiction. If, for reasons of international law, a different law is applicable, the interpretation of these General Terms and Conditions of Sale will primarily refer to the Belgian Code of Economic Law.
